In the area of intellectual property, Yuan Xing handled   considerable intellectual property cases and effectively protected the rights   and interests of his clients through civil, administrative and criminal   means. He served as the representative of many multinational and domestic   enterprises in intellectual property rights protection cases in China. These   cases range from patent infringement litigation and administrative complaint,   patent ownership litigation, patent invalidation proceeding, trademark   infringement litigation and administrative complaint, trademark invalidation   proceeding, trademark transfer and license, copyright infringement   litigation, trade secret infringement litigation and criminal proceeding,   technology transfer and cooperation, unfair competition litigation and   administrative complaint, antitrust related intellectual property license   issues, strategy design for intellectual property protection, etc.

In   the area of litigation and arbitration, he represented many multinational   enterprises, large state-owned enterprises and private enterprises in   litigations held in the Supreme People’s   Court, Higher People’s Courts, local People’s   Courts, and arbitrations before the CIETAC and other arbitration   institutions. He also dealt with an assortment of cases enforcing court   judgments and arbitration awards before Chinese People’s   Courts at all levels. These cases fall in various types including unfair   competition, real estate, insurance contract, sales contract, guarantee   contract, product quality liability, property damage, shareholder liquidation   liabilities, etc.

IP cases

l  He represented a   well-known foreign chemical company as plaintiff in a lawsuit concerning   business secrets against a well-known domestic chemical project design   company, as well as a large-scale domestic chemical product manufacturer and   its affiliated companies. In order to protect the Client’s interests to the   largest extent and exert pressures on the alleged infringing parties, in   addition to the abovementioned lawsuits, three lawsuits regarding patent   ownership and criminal procedures were also initiated. In the first instance   of the civil lawsuit concerning business secrets, a large amount of evidences   related to the infringement acts, including project drawings, was   successfully collected through an investigation order. The case is currently   under the process of trial.

l  He represented a   Japanese machinery manufacturer in multiple administrative lawsuits   concerning patent validity issue. These cases have been heard by Beijing   Intellectual Property Court and Beijing High People’s Court, and still in the   process of trial.

l  He represented a   Japanese machinery manufacturer in multiple patent infringement lawsuits, and   successfully preserved the defendant’s alleged infringing products at the   exhibition. Injunction was issued by Shanghai Intellectual Property Court and   Shanghai High People’s Court.

l  He represented a   well-known American pharmaceutical company as plaintiff in a patent   infringement lawsuit. This case was first heard by Jiangsu High People’s   Court, which determined an injunction and damages as claimed.

l  He represented a   Japanese financial equipment manufacturer in multiple patent infringement   lawsuits, and successfully preserved the defendant’s alleged infringing   products in the warehouse.

l  He represented a famous   Swiss watch manufacturer to take various legal measures to stop the   infringement of trademarks on Internet sales in China.

l  He represented a   Belgian toy manufacturer to take various legal measures against patent   infringements in China, and timely restrained abovementioned infringement   acts.

l  He represented a   well-known domestic manufacturer as plaintiff to file a patent infringement   lawsuit. The case was heard by courts at all levels, including the Supreme   People’s Court, and the results of judgement were satisfactorily accepted by   the Client. In this case, Mr. Yuan successfully obtained a pre-trial   injunction issued by the court.

l  He represented a   Japanese automobile manufacturer to sue two Chinese companies on four   trademark infringement cases and finally won the verdict.

l  He represented a Japanese   trading company to sue Chinese enterprises on three trademark infringement   lawsuits.

l  He represented a famous   Japanese commercial company in its administrative case regarding patent validity.

l  He represented a   foreign TV program production company to file a copyright infringement   lawsuit against music variety programs produced and broadcast by a large   domestic TV station and network media.

l  He represented a large   domestic TV station to deal with TV drama copyright infringement litigation   and obtain the first instance judgment.

l  He represented a large   domestic digital company, listed on NASDAQ, to respond to a number of   copyright infringement disputes held in Guangzhou Intermediate People’s Court   and Guangdong High People’s Court.

l  He represented a   leading B2B company in the UK in response to a lawsuit against infringement   of copyright of works and right of information network dissemination in   Beijing Second Intermediate People’s Court and Beijing High People’s Court.

Dispute Resolution Cases

l  He represented a   well-known domestic financial leasing company to file a lawsuit against the   supplier and negotiate on behalf of the client on several contracts of   financial leasing, sale and purchase, etc. in the process of financial   leasing.

l  He represented a   well-known American manufacturer as plaintiff to spontaneously initiate   arbitration and negotiation process towards domestic manufacturers, regarding   the projects providing design, software and hardware services in China. The   case was settled.

l  He represented a   famous American manufacturer as plaintiff in arbitration against its domestic   supplier, regarding the sales contract and quality issues of products. The   arbitration was conducted in English. The case is currently under the process   of trail.

l  He represented a   famous domestic science and technology enterprise to negotiate and file a   lawsuit on the quality of the products against the sales agency of a leading   domestic enterprise. The case is still under trial.

l  He represented a   well-known domestic aviation company to file a lawsuit against a domestic   dealer and its legal representative, regarding a dispute arising from its   cross-border trade. The court supported all requests raised by the Client.

l  He has   represented a well-known Japanese company in recovering nearly 300 million   yuan of its debts in China, involving more than a dozen projects of the   Client in China, and this recovering process is still ongoing.

l  He represented an   Israeli agricultural company, as the defendant in several cases of product   quality liability dispute, the case was settled eventually.

l  He represented a   well-known domestic game company to negotiate with the overseas counterparty,   regarding plenty of disputes related to the content of games.
